 FORUM OF CIVIL PENSIONERS ASSOCIATIONS (FCPA) New Delhi - Circular No. FCPA/2026/4..Dated: 3rd November, 2026

To

All Constituents of FCPA

Dear Comrades,

Sub: (1) Confirmation of Venue for Parliament March / Dharna on 25-11-2026

(2) Supreme Court case against Validation of Pension Rules Act, 2025 listed today - reg.

1. DELHI DHARNA ON 25-11-2026 - VENUE CONFIRMED

            As already notified in our earlier circular, the Parliament March decided by the FCPA meeting on 19-07-2026, as the culmination of the 3-phased struggle on the 11-point Charter of Demands, will be held on 25th November, 2026.

       Our first application dated 22-10-2026 to the Deputy Commissioner of Police, New Delhi seeking permission to hold the Dharna at Jantar Mantar was rejected on the same day stating that Jantar Mantar has been de-notified as a protest site by Delhi Police. We were advised to seek permission for any of the three alternate venues, namely Ramlila Ground, Burari Ground and CBD Ground.

      We sent another application on 23-10-2026 seeking permission to stage the Dharna at BSNL NTR Compound, Eastern Court, Janpath, New Delhi, as the alternate venues are far away from Central Delhi and also costly, which cannot be afforded by pensioners' organisations. Thereafter, the office of the DCP, New Delhi sought some more details, which were furnished promptly. When Com. G.L. Jogi, General Secretary, SNPWA and Com. R.K. Mudgal, General Secretary, MREWA pursued the matter in person, the police authorities agreed to our proposal of Eastern Court.

               We are happy to inform that permission has been obtained for holding the Dharna at BSNL NTR Compound, Eastern Court, Janpath, New Delhi - 110001. The venue is centrally located near Janpath Metro Station (Gate No. 4) and very close to BSNL Corporate Office.

All affiliated organisations are requested to:

a) Mobilise the allotted quota of comrades without fail.

b) All participants are requested to reach the venue before 9.30 AM. The Dharna will be held from 10.00 AM to 1.00 PM in a disciplined manner. Prominent leaders of Central Trade Unions, Service Organisations and Pensioners' Organisations will address the Dharna.

25-11-2026 WILL BE A HISTORIC DAY OF STRUGGLE OF CENTRAL CIVIL PENSIONERS.

2. SUPREME COURT CASE AGAINST VALIDATION OF PENSION RULES ACT, 2025 - LISTED TODAY*

          As you are aware, the Government of India, through Part-IV of the Finance Act, 2025, has enacted "Validation of the Central Civil Services (Pension) Rules and Principles for Expenditure on Pension Liabilities from the Consolidated Fund of India" with retrospective effect.

This draconian provision seeks to:

i) Nullify the settled law laid down by the Supreme Court in D.S. Nakara Vs. Union of India (1983) that pensioners forming a homogeneous class cannot be divided on the basis of date of retirement;

ii) Empower the Government to decide the effective date of implementation of Pay Commission recommendations, thereby denying arrears;

iii) Override the Delhi High Court judgement dated 20-03-2024 in the S-30 Pensioners case, which was upheld by the Supreme Court on 04-10-2024.

Against this, NCCPA, All India S-30 Pensioners Association, and Forum of Retired IPS Officers (FORIPSO) have filed Writ Petitions in the Supreme Court.

The Writ Petition W.P.(C) No. 525/2025 - NCCPA and 18 Pensioners Associations, All India S-30 Pensioners Association Vs. UoI and other tagged matters challenging the constitutional validity of the Validation Act was posted for hearing today, i.e., 03-11-2026.

        Our Advocate, Senior Counsel Shri Vikas Singh appeared on behalf of NCCPA/FCPA. The case is being argued that the Validation Act is ultra vires, violative of Articles 14, 16 and 21, and is a colourable exercise of power to overrule judicial verdicts.

However, to our dismay, the case has once again been adjourned to 01-12-2026 as the Attorney General was not present. It is nothing but delaying tactics on the part of the Government.

              This case is directly linked to our main demand of "Scrap the Validation of Pension Rules Act, 2025", which is Item No.1 of our 11-point Charter of Demands. Therefore, the success of our Delhi March on 25th November has become even more crucial.

With warm regards,

Fraternally yours,

K.G. Jayaraj

Offg. Secretary General, NCCPA
